General terms and conditions for the implementation of language training (hereinafter referred to as general conditions) are part of the contract for the implementation of language training for individuals and legal entities between the provider, the company GENKI CENTER, with its registered office at Brilejeva ulica 13, 1000 Ljubljana, Slovenia (hereinafter referred to as the provider), and the individual or legal entity that accepts the offer of language courses from the provider (hereinafter referred to as the client).
The general conditions supplement specific agreements between the contractual parties and bind them as such. In case of any inconsistency between the provisions of the general conditions and specific agreements, the provisions of the latter shall prevail.
- COMPANY BUSINESS ACTIVITIES
The company operates under the GENKI CENTER service brand. As part of its activities the company offers a variety of tailor made services created in accordance with the needs of individuals enrolling in different language courses. The varieties include: individual language courses (herein referred to as individual courses), and group language courses (herein referred to as group courses).
All our language courses (herein referred to as courses) are conducted employing the company’s own GENKI CENTER teaching method. Courses conducted for companies are carried out by qualified contracted staff members (herein after referred to as language teacher/s) and company employees.
- DEFINING CLASS LENGTH UNITS
- The introductory lesson is a possible (and not mandatory) free meeting for the purpose of meeting with the assigned language coordinator and it can last up to a maximum of 50 minutes (but not necesarry).
- The length of each individual class lasts for 50 minutes.
- A class is considered a one-time uninterrupted period within one working day during which the teacher and the client conduct course activities.
- All dates stated in these general terms and conditions of business are referring to weekdays (MON-FRI) unless specifically agreed upon otherwise.
- 1 day is referring to a 24 hour period.
- 1 week is referring to 7 consecutive days.
LANGUAGE COURSES
- INDIVIDUAL COURSES
Individual course schedule is determined before classes commence.
- GROUP COURSES
The group course schedule is determined before classes commence. Maximum number of participants in a group is 5 (five) people.
COURSE ENROLLMENT
Client fills up a introductory form from our page, The client will be contacted by a Language Coordinator to arrange a short meeting in order to enroll into a course. The client will be signed up into a Online Learning Platform Genkicenter-Ayotree. The client receives a contract and an invoice before start. The client after the payment of the invoice starts with the course.
HOW COURSE WORKS
All courses are conducted online and with a designated live Japanese Language Teacher. The frequency of the weekly courses depends on the chosen package the client chooses. All lessons are conducted via online platform Ayotree.
CANCELLATION OF CLASSES
- course termination by the company
Any inappropriate behaviour towards the teacher or the company is considered offensive and thus reason enough to terminate the course. These include verbal, sexual or obscene behaviour. The client should not come to class drunk, or under the influence of psychotropic substances.
A client, who is regularly tardy for scheduled classes, leaves classes early or makes it difficult for either the teacher to teach or their class colleagues to follow the course program may be banned from further classes.
The client is not to negotiate private lessons with the teacher outside of the company arrangements (for themselves or for their family members) and doing so will result in a ban from the course. In cases as such, the client will not be refunded for the reminder of the course and is treated under the same conditions as a person who unjustifiably terminates all course activities by themselves.
2. course termination by the client
If a client wishes to terminate the course before it’s due date, it can do so by sending an email to address: info@genki-center.com stating the reason of termination at least 2 days (48 hours) before the next scheduled lesson. The client will be reimbursed with the payment of the lessons that are yet scheduled in the future. A cancelation fee of 55,00€ will be charged to client.
PURCHASE AND PAYMENT POLICY
- CLASS AND COURSE PURCHASES
Upon completing a purchase for a class or a selected course from the company, the client must confirm the date of the introductory meeting (free presentation and introduction hour) in writing via e-mail at: info@genki-center.com
To complete the purchase and/or course selection, the client must also notify the company of their selection in writing via e-mail at: info@genki-center.com. The company will store the signed contract and the electronic correspondence with the client, who may access it upon request at any given time.
- PAYMENT TERMS
Registration fee: Those who are studying for the first time at Genki center will be charged a 55,00€ registration fee. The registration fee covers expenses required for enrollment procedures, and level assessment. The registration fee is not refundable in case of early termination.
Tuition: Payment is required in advance. All lessons are non-transferable and may only be taken by the person whose name is indicated in the contract.
Others: fees for textbooks and/or other materials may apply.
The client is obliged to pay the issued invoice on time. In case of late payment, the client is entitled to inform the company immediately. Invoices are sent to the client regularly to their email address and are also reachable via online platform genkicenter@ayotree.com under their personal profile: billing > pending invoices.
If the client does not withdraw from the course, he is obliged to pay the full amount of the course according to the issued invoice before starting or continuing with lessons. Payment is due within 8 days of the invoice date.
The client is to pay the agreed amount via bank transfer to the transaction account of the company stated on the invoice. The company issues a pro forma invoice or invoice to the customer’s e-mail address in PDF form.
LAGUAGE TEACHER SELECTION – AMENDMENTS AND GROUP MEMBER ALTERATIONS
- LANGUAGE TEACHER SELECTION
The client is not entitled to choose their own language teacher. The teacheris assigned to the client by the company administrator according to their professional criteria. If, for any reason, the client becomes dissatisfied with the assigned language teacher, he can inform the administrator and request a change. The company can provide a suitable replacement at its own discretion when the reasons for the request are deemed well founded. The company reserves the right to reassign a new language teacher if it deems that doing so is necessary.
- GROUP MEMBERS CHANGES
The company reserves the right to switch members of groups, to regroup and separate members if there are well-founded reasons for such proceedings based on group member incompatibility, timing issues or level of quality maintenance needs.
DATA PROTECTION, SETTLEMENT OF DISPUTES
- DATA PROTECTION REGULATION
The client agrees that the company may collect, use, process and store their personal data for the purposes of organisation and management of company activities and for smoother communication. The client agrees that the company is free to contact them through personal messages via services (SMS, Viber, WhatsApp, e-mail or postal service) in order to provide information. The company is committed to protecting and respecting the client’s privacy. Any collected personal data from the client will be processed by the company and in compliance with the 2018 EU General Data Protection Regulation (GDPR) The company will not share any information on the client with a third party without client’s consent.
- LEGAL ACTION AND DISPUTE SETTLEMENT
The company and the client will try to resolve all disputes amicably. If amicable dispute resolution is deemed not possible, a dispute settlement will be sought in a court of law.
